Law Services - Apostille: basic

We are sure that everyone has heard this term at least once, and most of them have come across it directly.

APOSTILLE
🤔What is an apostille? What is it needed for?

🔹Apostille is a special stamp that is placed on official documents and gives legal force to the document for its use abroad.

For example, you received a court decision and you need to use it abroad.

🙅🏻‍♀️Just showing a copy of the decision issued to you by the court will not work.

☝🏻To begin with, this court decision must be legalized – put an apostille on the territory of Ukraine, otherwise this decision will simply not have legal force on the territory of another state.

💁🏻‍♀️That is, if you need to present Ukrainian documents to some official institutions abroad, they must be with an apostille stamp.

🔶Apostille can be applied to the following documents:
🔸certificates issued by the RACS bodies: about birth or death, marriage or its dissolution, adoption of a child, name change, etc.;
🔸 notarial acts;
🔸 court decisions;
🔸documents about education;
🔸 other official documents issued on the territory of Ukraine.

🔻Important🔻

The document on which the apostille is affixed requires an official translation into the language of the country in which the document will be used.

📌Further, the translation must be notarized, and only then is the document considered legalized and subject to use on the territory of another country.

❗️From January 1, 2023, some of the documents previously apostilled by the Ministry of Foreign Affairs will be certified by the Ministry of Internal Affairs, the Ministry of Internal Affairs, and the DPC. 🔷So, now:
🔹The Ministry of Internal Affairs puts an apostille on documents issued by this ministry and its territorial bodies, except for documents related to the field of education and science.
🔹Ministry of Education and Science puts an apostille on official documents issued by this ministry, as well as by territorial bodies, educational institutions, enterprises, institutions and organizations that provide services in the field of education and science or conduct other activities related to the provision of such services.
🔹The Ministry of Justice puts an apostille on documents issued by justice bodies, courts, state archival institutions, bodies for the execution of punishments and probation; as well as on documents drawn up by state or notaries of Ukraine.
🔹DMS places an apostille on documents issued by this service, its territorial and territorial subdivisions related to the field of migration.
🔹DPS puts an apostille on documents issued by this service and its territorial bodies

The Ministry of Foreign Affairs puts an apostille on all other types of documents, but the Ministry of Foreign Affairs will no longer put an apostille on the documents listed above.

The documents from the list above will be returned without review, because from January 1, the authority to certify these documents with an apostille belongs to other authorities.

To affix an apostille, you must submit:

the original of the document on which the apostille is affixed, or its copy certified in accordance with the established procedure;
a document on payment for the service of affixing an apostille or a document confirming the right to exemption from payment, or its copy, certified in the prescribed manner;
a statement from the person submitting such documents.
