💁🏻♂️ we, as lawyers, are often approached with questions that only a NOTARY can help with.
🤔 yes, there is no common understanding in society between the powers (competence) of a lawyer and a notary public.
When you have pain 🦷, you don’t go to the eye doctor, do you? Or if you want to drink water, you don’t drink wine? Agree, the last example is not quite successful 😁
🥲 there is an opinion that this is one and the same profession, and as a result, this leads to citizens turning to the “wrong address” to solve their problem.
☝️ that’s why we want to briefly describe the difference between a lawyer and a notary so that you know when and which specialist you need to contact.
📌Let’s start with the common:
✅ have a higher legal education
✅ can advise on certain legal issues
There are many more differences.
📌 We contact a notary when:
✅ it is necessary to certify the transaction, for example:
📝 purchase contract – sale/gift/loan 💰/hiring (lease), marriage contract; an agreement on the division of marital property and many others.
✅ certify a will, power of attorney
✅ open an inheritance case, accept an inheritance
✅ certify the authenticity of the signature on the documents;
✅ certify the accuracy of the translation of documents from one language to another, etc.
☝️ only a notary can issue you a power of attorney to represent the interests of another person in institutions, organizations of various forms of ownership and other types of powers of attorney.
☝️ only a notary can certify copies of documents so that they later have the status of notarized.
🥑 you can consult a lawyer on all the issues listed above, but you cannot do without the services of a notary here🙅🏻♂️
📌 LAWYERS perform protection, representation and provision of other types of legal assistance to the client.
👨🏻💻 You can get advice or clarification from a lawyer on any legal issues, including the need to conclude a contract, the consequences for the parties, after the contract is concluded, etc.
✅ the lawyer will help you in drawing up statements, complaints, procedural and other legal documents, for example:
• a claim for dissolution of marriage, collection of alimony, division of marital property, collection of debts under the contract, compensation for material and moral damage, etc.
• preparation of feedback, responses to feedback, objections, petitions, appeals and cassation complaints, etc.
✅ according to the power of attorney, previously certified by a notary, the lawyer can act on your behalf and enter into contracts of purchase – sale, gift, mine, etc., and will also be able to collect the necessary package of documents for certifying the deed.
✅ a lawyer protects citizens in court, acting as a representative of the plaintiff, the defendant, or a third party.
☝️ the lawyer does not certify the consent for the child’s departure abroad to one of the parents, however, he can provide clarification on other options for departure, if the other parent refuses to give such consent.
Feel the difference? 😌
Have you ever confused a notary and a lawyer and turned to the wrong specialist?
