Who is entitled to help
The right to partial unemployment benefits is available to employees and self-employed persons who, during the last six months preceding the month in which the stoppage (reduction) of production (performance of work, provision of services) began, which led to the loss of part of their salary (income), paid (paid) EUV.Criteria for granting partial unemployment benefits
• stoppage (reduction) of production (performance of work, provision of services) covered at least 20 percent of the employer’s workforce, in which the level of reduction in working hours and wages is 30 percent or more per month;
• the level of reduction in the duration of working hours and physical income;
• an entrepreneur who is an insured person is 30 percent or more per month;
• lack of arrears from the employer or natural person – an entrepreneur who is an insured person, from the payment of wages and/or payment of social security, and/or payment of insurance premiums for mandatory state pension insurance during the six months preceding the month of suspension (reduction) production of products (performance of works, provision of services);
• payment by the employer for each employee or natural person – an entrepreneur who is an insured person, of the Social Insurance Institution during the last six months preceding the month in which the stoppage (reduction) of production (performance of work, provision of services) began, and in the event that during in the last six months prior to the application for partial unemployment benefits, the law has given the right to individual employers or natural persons – entrepreneurs who are insured persons, not to pay ESS, the previous 180 calendar days before such period are applied;
• the employer is not a social insurance fund.When is help not provided?
Partial unemployment benefit is not granted if:• stoppage (reduction) of production (execution of works, provision of services) is seasonal in nature or occurs exclusively for organizational and production reasons;
• the employee refused employment (temporary transfer) to a suitable job with the employer with a full working day (week) or works for the employer part-time, or undergoes alternative (non-military) service;
• during the six months preceding the month of stoppage (reduction) of production (performance of work, provision of services), the employer or natural person – entrepreneur, who is an insured person, has arrears for the payment of wages and/or the payment of a single contribution to the general condition mandatory state social insurance, and/or payment of insurance premiums for mandatory state pension insurance;
• an employer or a natural person – an entrepreneur who is an insured person, is in the process of terminating a legal entity, terminating business activity, has been declared (recognized) bankrupt in accordance with the established procedure or a bankruptcy case has been initiated against him (her), is in the process of rehabilitation;
• the employer is a body of state power, a body of local self-government or an institution, institution, organization formed by these bodies in accordance with the established procedure and which are fully supported by the state or local budget. How is the benefit calculated?
The benefit is provided monthly in proportion to the reduced working hours of the employee or FOP, which is an insured person. In p.9 of the resolution gives the formula for calculating this time.
When can you apply for financing?
An employer or an individual entrepreneur who is an insured person can apply for partial unemployment benefits within 90 calendar days from the day of stopping (reduction) production (performance of work, provision of services).
