The issue of paying sick leave during downtime was jointly discussed by representatives of the Ministry of Social Policy, the Ministry of Economy of Ukraine, the State Labor Service of Ukraine and the Social Insurance Fund of Ukraine. Based on the results of the discussion, the Ministry of Social Policy issued a corresponding clarification dated 07.05.2022 No. 6700/0/2 -22/45 and it is established that if the employee during downtime is obliged to follow the work schedule or has the right to maternity leave, temporary disability benefits are provided for all days of disability for which the employee loses pay. In other cases , if during prolonged downtime the employee does not obey the rules of internal labor regulations – there are no grounds for paying sick leave both at the expense of the employer and at the expense of the FSSU. connection with no loss of income due to temporary incapacity. At the same time, since the payment of downtime due to no fault of the employee is included in the guarantee and compensation payments of the additional salary fund as payment for time not worked, in the event of an illness of an employee who does not have the right to pay sick leave, the payment of downtime is retained for him calculated not lower than two-thirds of the established salary.
