Probably most drivers have heard about Article 130 of the Code of Criminal Procedure

Usually for everyone it is drunk driving. Be it alcohol or drugs.

Did you think so too?

And what if we say that article 130 has as many as 7 parts?

For example, did you know that if a person got into an accident, and in order to calm down a little (relieve the stress from the experience), drank at the scene of the incident, then part 4 of Article 130 of the Code of Criminal Procedure awaits him.

Yes, part 4 stipulates that the use of alcohol, narcotic drugs, psychotropic substances, their analogues, as well as medicinal products made on their basis by a person who was driving a vehicle after a traffic accident involving her, entails a fine of UAH 34,000 , with deprivation of the right to drive vehicles for a period of three years OR administrative arrest for a period of 15 days, with deprivation of the right to drive for three years.

That is, the use of alcohol, narcotic, psychotropic substances, their analogues, as well as medicinal products made on their basis after a traffic accident, entails a stricter responsibility than driving a vehicle while intoxicated.

Let’s take a closer look at what causes liability under Article 130 of the Code of Criminal Procedure.

Liability under Art. 130 of the Code of Criminal Procedure occurs in the following cases:

1) driving a vehicle while intoxicated;

2) driving a vehicle while under the influence of drugs;

3) driving a vehicle under the influence of drugs that reduce attention;

4) transfer of control of the vehicle to a person who is in a state of intoxication;

5) the driver’s use of alcohol, drugs, or medications after an accident involving him;

6) consumption of alcohol, drugs, or medicines by the driver after being stopped by the police;

7) refusal to undergo an examination at a health care institution.

The most common violations are, of course, driving a vehicle under the influence of alcohol or drugs and refusing to pass an inspection.

Are you asking if it is possible to avoid the sanction?

Let’s answer that nothing is impossible)

You can always try to challenge certain actions or the correctness of drawing up the protocol.

In general, those who do not take risks drink champagne and do not get behind the wheel for the next 1-3 years.
