Law Services - How to terminate an employment contract if the employer has disappeared?
      Yes, and it happens!
What the case law tells us – proceedings № 2/679/208/2021 case № 679/185/21.
👨‍🔧In 2014, roofer Oleksandr signed a permanent employment contract with a private individual. Already in 2015, the employer stopped paying salaries, and then stopped communicating with the employee! It was also not possible to find a private individual at the place of residence specified in the contract.
      As a result, the employee could not:
to be released
legally get another full-time job
get the status of the unemployed
    Yes, the employer violated such employee rights:
the right to work
the right to remuneration
the right to make compulsory social contributions
👨‍⚖️ The employee terminated the employment contract in court. Netishyn City Court of Khmelnytsky Region upheld his claim in its decision of 02.04.2021 in the case № 679/185/21.
      So, in order not to get into a similar situation, LAWYERS “УURISVEST” recommend to check the future employer before getting a job:
-in the Unified Register of Debtors;
-in the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Associations;
-in the Unified State Register of Judgments.
If you want to check your current employer, also go to the PFC website and check the data on your insurance record (the number of working days for which the employer paid insurance premiums for you). Information is provided for all years and months of the person’s work:
